Privacy Policy – Classic Collision, LLC

This Privacy Policy, as amended from time to time (this “Policy”) explains how Classic Collision, LLC and certain of its affiliates and subsidiaries including Ultimate Auto Glass, LLC (collectively, “Classic Collision,” “we,” “our” or “us”) collect and use information, and your choices with respect to such information.

This Policy applies to information we collect through (1) www.ClassicCollision.net, www.ClassicCollision.com, www.ultimateauto.glass, the websites of our operating subsidiaries and affiliates, and our other websites and applications (collectively, our “Applications”), (2) direct contact with Classic Collision at its physical locations, (3) email or electronic newsletters, (4) text messages, (5) offline methods, such as in person, telephone and traditional mail and (6) any other methods or applications you use to connect with us (collectively, the “Collection Points”).

Each time you access or use a Collection Point, you acknowledge and agree that you have read, understand, and agree to be bound by this Policy.

Generally.

We collect information from you through our various Collection Points, which can include your use of our Applications, contacts with our customer service associates, information about your insurance policy, including information obtained from you and from insurers. All the information we collect is referred to as “Collected Information.”

Personal Information.

Some of the Collected Information includes personal information, such as your name, address, email, phone number, vehicle description, license plate number, vehicle identification number (VIN), insurance policy information, driver’s license number and credit card information. You can also submit personal information about other people, for example if you schedule service for someone else. We keep your personal information for the purposes for which it was originally collected, for other purposes to which you have subsequently consented, and for other reasonable business purposes, as permitted or required by applicable law (such as regulatory compliance).

User Content.

If you use our Applications to submit comments or other content (“User Content”), that User Content becomes Collected Information and we can reproduce, publish, distribute or otherwise use such User Content in any media or format currently existing or later developed without additional consent. Limited personal information may be publicly displayed along with and/or associated with your User Content. Please think carefully before deciding what information you share as User Content. We reserve the right to refuse or delete any User Content. Please note that we do not control who will have access to the information that you choose to make public, and cannot ensure that parties who have access to such publicly available information will respect your privacy or keep it secure. We are not responsible for copyright compliance, legality, integrity, quality, accuracy, use or misuse of any User Content. We do not endorse or control User Content and we disclaim all liability with regard to such User Content. If you provide us with any ideas, comments, suggestions, or other feedback related to Classic Collision’s products, services or business, you grant us a perpetual, royalty-free, worldwide right to use it for any purpose related to our business without compensation to you.

Information Collected as You Access and Use our Applications.

We may use tracking tools to make the websites and applications work, and to learn more about users, as well as information relating to their visits and interactions with our Applications. These tools may include cookies, tracking pixels, web beacons and embedded scripts (“Tracking Tools”). We also may collect information regarding your web browser or device and collect location information where you have permitted us or a third party advertiser or service provider to do so. “Do Not Track” (DNT) is a web browser setting which lets websites you visit know that you do not want them collecting information about you. We do not respond to DNT settings or signals.

Web Browser or Device Information.

We collect information sent by your web browser or device, including your IP address, and other information that does not identify you personally such as a device or browser token, the date and time of your visit, information about your web browser or device type. The information received depends on the settings on your web browser or device.

Classic Collision uses the Collected Information for a variety of business purposes in compliance with applicable law.

Business Operations.

We use the Collected Information to operate our business, which includes (1) providing you with, and communicating with you about, Classic Collision products and services, (2) allowing you to access and participate in our Applications and features, (3) managing and improving our products, services and Applications, (4) personalizing your user experience; (5) reporting on various activities for historical, statistical or research and analysis purposes; (6) other purposes to which you consent; and (7) any other purpose as disclosed to you at the time you provide your information or as set forth in this Policy.

Respond to Requests.

When you are making a request to us, we use the Collected Information you provide to respond to such requests. When you provide us with personal information, including your contact information, in connection with a particular activity, product or service, you expressly consent to our communicating with you about your request.

Legal Requirements and Fraud Prevention.

Classic Collision is committed to complying with all applicable legal requirements and to taking reasonable steps to protect you, Classic Collision, and others from fraud or other security breaches. As a result, we may disclose information when we, in good faith, believe disclosure is required or appropriate to comply with the law or a regulatory requirement; to comply with governmental, administrative or judicial process, requirement or order, such as a subpoena or court order; to cooperate with law enforcement or other governmental investigations; to prevent or investigate a possible crime, such as fraud or identity theft; to enforce a contract; to protect the legal rights, property, or safety of Classic Collision and its employees, clients, partners and agents, other users or the public in general; or to protect your vital interests if determined necessary by us in our reasonable discretion. We also reserve the right to, without providing notice, report to appropriate law enforcement or government agencies any activities that we, in good faith, believe are in violation of applicable laws, rules or regulations.

Registration.

Within our Applications, you can register if you would like to receive updates on our services.

Choices Regarding Use of Personal Information.

You are not required to provide us with your personal information, however please be aware that we may not be able to provide you with certain products or services if you choose not to provide us with that information. Except as otherwise described in this Policy, we do not use or share the personally identifiable information provided to us in ways unrelated to the purpose for which you provided it, unless we first provide you an opportunity to opt-out or otherwise prohibit such unrelated uses. You can also review and update your personal information in our possession.

Applicable Law.

Access or use of the Applications is intended for users located within the United States. If you are not located within the United States, please be aware that information we collect will be transferred to, processed in, and stored in the United States. The data protection laws in the United States differ from those of other countries, and your personal information can be subject to access requests from governments, courts, or law enforcement in the United States. By using an Application or providing us with any information, you consent to the transfer, processing, and storage of your Collected Information in the United States. You are also consenting to the application of the laws of the United States in all matters concerning Collected Information and this Policy.

Childhood Information.

Our Applications are intended for use by general audiences and we take reasonable steps to ensure we do not collect personal information from children under the age of 13 without verifiable parental consent (“Childhood Information”). We will delete any Collected Information that we later determine was Childhood Information.

Security.

We have implemented safeguards reasonably designed to protect Collected Information from unauthorized access and disclosure. However, no commerce solution, website, application, database or system is completely secure or “hacker proof,” and we cannot anticipate all potential misuse of your information. We cannot guarantee the security of any information you transmit to us, and your use of any Collection Point indicates that you are willing to accept and assume this risk.

California Privacy Rights.

California Civil Code Section 1798.83 permits online users of the Applications who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.

Changes to this Policy.

This Policy will be updated from time to time and all changes will become effective when posted. The date the Policy was last updated is shown at the bottom of the Policy.
